1. Acceptance of Terms
By accessing or using the Nawiri Experts portal ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform. Access is granted solely to authorised personnel of Nawiri Experts Limited.
2. Authorised Use
The Platform is provided exclusively for legitimate business activities of Nawiri Experts Limited. Authorised uses include:
- Managing employee and employer records.
- Processing job applications and recruitment activities.
- Administering company operations as assigned by your role.
- Generating approved reports and analytics.
3. User Accounts and Credentials
- Each user is assigned a unique account. Sharing credentials is strictly prohibited.
- You are responsible for all activity that occurs under your account.
- Passwords must be changed periodically as required by the system (every 45 days for superadmin; 60 days for directors).
- You must notify the system administrator immediately if you suspect unauthorised access to your account.
4. Prohibited Activities
You must not:
- Access data, systems, or features beyond those permitted for your assigned role.
- Attempt to bypass, circumvent, or disable any security mechanism.
- Introduce malicious code, scripts, or software into the Platform.
- Use the Platform to harass, defame, or harm any individual.
- Share, export, or disclose confidential data without prior written authorisation.
- Use automated tools (bots, scrapers) to extract data from the Platform.
5. Data Ownership
All data entered into or generated by the Platform remains the property of Nawiri Experts Limited. Users have no personal ownership rights over company data accessed through the Platform.
6. Confidentiality
All information you access through the Platform — including employee records, salary data, client details, and business strategies — is strictly confidential. This obligation survives the termination of your employment or engagement with Nawiri Experts Limited.
7. Monitoring and Audit
All activity on the Platform is logged and may be monitored for security, compliance, and performance purposes. By using the Platform you consent to such monitoring. Logs may be reviewed as part of internal investigations or in response to legal requirements.
8. Availability
We strive for high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, emergency fixes, or events beyond our reasonable control.
9. Intellectual Property
The Platform, including its design, code, content, and documentation, is the intellectual property of Nawiri Experts Limited. You may not copy, modify, distribute, or create derivative works without prior written consent.
10. Termination of Access
Access to the Platform may be suspended or revoked at any time, with or without notice, if we believe you have violated these Terms or if your employment or engagement with Nawiri Experts Limited ends. Upon termination, you must immediately cease using the Platform.
11. Limitation of Liability
To the maximum extent permitted by law, Nawiri Experts Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the Platform.
12. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
